Why Aren't Insurance Companies, Their Defense Attorneys & Their Medical-Legal Doctors Ever Prosecuted For Workers Compensation Fraud?

 

 

Because simply put, no one cares. It's all about money and power! It's not about truth and justice, nor fairness and equity, it's simply about the almighty dollar and the power that goes with it!

Research and investigation has shown that there is a great reluctance by the Fraud Investigation Unit of the Department of Insurance and County District Attorneys from all over the state, to investigate and prosecute blatant acts of fraud (as defined by Insurance Code Section 1871.4) committed by Workers Compensation Insurance Carriers, Third Party Claims Administrators, their Medical-Legal Doctors and their Defense Counsel.

PREFACE
While we at CIFTF acknowledge that Worker Fraud, as well as, Employer Fraud do exist at some level, we firmly believe Insurer Fraud is more prevalent and more costly to the public than the combined total of the former.

Worker Fraud has been studied and reported in several studies at levels of less than 1%. Claims at other rates of up to 20 & 30% are simply advertising numbers created by the insurance industry to distract us from the true fraud taking place; none of these claims are supported by fact based studies.

Employer Fraud has been studied, but dissected and reported in such a way that the total effect is unknown; while appearing to be present in how wages are reported versus the cost of premiums. And, how employees are classified to avoid Workers' Compensation costs [independent contactor status], and in fraudulently providing Workers' Compensation coverage through an affiliated company in a less dangerous [risk valuation] occupation, i.e. a roofer is injured, but covered by a flooring company.

OUR GOAL
The goal of the California Insurer Fraud Task Force [CIFTF] is to bring together the people and resources necessary to educate the general public and injured workers, as well as, attorneys [applicant/defense], insurance regulators, our elected representatives, and the courts, although one must first believe that our leaders are unaware of the crisis within the insurance industry and have no idea of the fraud and deceit that has become such an intrinsic part of the claims process.

We strive to expose the fraudulent practices utilized by the insurance industry, i.e. claim handlers, physicians, private investigators, attorneys, etc. and to demonstrate the disastrous and costly effects suffered by the injured workers of California, as well as, to the taxpayers in general.

We will make every attempt to see to it that Insurer Fraud shifts from the living room conversations of injured workers to the Courtroom for prosecution to the fullest extent the law allows.

With a mission to restore balance, to rectify the pitfalls of the claim process, and to expose the [protected] illegal activities of insurance companies and their ilk, we may reach our ultimate goal of bringing logic and balance to the claims process.

Insurance companies are in business to pay claims, nothing else. Insurance company representatives should never be allowed to assess medical conditions, decide benefits, or evaluate disabilities. As long as there is a financial incentive involved in the process, fraud will always be an option available and used "to protect the bottom line", especially when an Adjuster, a Claims Supervisor, and/or "Company Doctor" is the "adjudicator" of a claim.

It is with those thoughts in mind that we accept our task to make sure that justice is fair and equitable for all, and that those who choose to violate the laws are convicted and punished for their crimes.

The time to act is NOW! The next innocent person the insurance companies may come after MAY BE YOU!
