California Insurance Code, Sections 1871.4 et al. are the most common sections of the code that are used to prosecute those who violate it's provisions, except for employer offenses, which are a separate matter altogether.
Let's look at the wording of the California State Insurance Code for a better understanding of how it pertains to fraud:
Section 1871.4a 1,2 & 3 of the California State Insurance Code which states:
(2) Present or cause to be presented a knowingly false or
fraudulent written or oral material statement in support of, or in
opposition to, a claim for compensation for the purpose of obtaining
or denying any compensation, as defined in Section 3207 of the Labor
Code.
(3) Knowingly assist, abet, conspire with, or solicit a person in
an unlawful act under this section.
It doesn't matter if you are an injured worker, an employer, claims examiner or insurer. If you violate the above sections of the Insurance Code, the law is there to protect us all! The law is the law and it must be enforced equally and it's protections afforded to all!
